McDougall Vacancies Likely to Go Unfilled

Both seats will be up for election in March.

The chairmen of both the Salem Budget Committee and Zoning Board of Adjustment do not anticipate filling the seats expected to be vacated by Patrick McDougall before the March town election. McDougall told the Eagle-Tribune he intends to resign from both boards after a Salem Circuit Court judge found him guilty on a misdemeanor obstructing government administration charge stemming from a June incident at his Tiffany Road home. McDougall's term on the Zoning Board is scheduled to expire in March 2013 while his term on the Budget Committee runs through March 2014. Zoning Board Chairman Gary Azarian said his board "will use alternates to fill the vacancy until the March election." Since the Zoning Board meets monthly, there would be three …

No Verdict in McDougall Obstruction Case

Salem elected official facing a charge related to a June incident at his home.

Salem Circuit Court Judge Michael Sullivan did not issue a verdict in the obstructing government administration trial of Salem Budget Committee and Zoning Board of Adjustment Patrick McDougall Monday. Sullivan heard a couple hours of testimony Monday and took the testimony under advisement. McDougall was charged in July on the misdemeanor charge after an incident that took place in June involving his wife, Jane, who was suffering from a migraine headache and called 911 at their Tiffany Road home. McDougall is alleged to have argued with responding Salem Fire personnel, and later Salem Police, regarding an ambulance ride to a hospital. McDougall Misdemeanor Trial Slated For Today

Local elected official faces Class A misdemeanor for June obstructing government administration charge.

The trial for Salem Budget Committee and Zoning Board of Adjustment member Patrick McDougall on a misdemeanor obstructing government administration charge is scheduled for today. On Friday, a clerk at the 10th Circuit Court of Salem said McDougall's trial will take place at 1 p.m this afternoon. McDougall, 38, was charged with the misdemeanor after a June 26 incident when he allegedly refused to allow paramedics to take his wife to the hospital after she'd called 911 complaining of a migraine. McDougall later took his wife to the hospital himself. At a hearing in October, the charge was changed from a Class B misdemeanor to a Class A misdemeanor. Class B misdemeanors carry up to a $1,200 fine while Class A misdemeanors carry up to a $2,000…

ZBA Grants Four-Month Extension for Demers Property

Owners of damaged Martin Avenue home is considering appealing decision.

A Martin Avenue family displaced since an oil spill at their home five years ago got something of a "good news/bad news" decision from the Salem Zoning Board of Adjustment Thursday night. The good news is the board is allowing the family to continue having a mobile home on their property as they attempt to clean up the 21 Martin Ave. dwelling still facing significant problems. The bad news for the family is they did not get the 12 month extension they were seeking, instead the board granted a four-month extension. In an e-mail Friday, Michael Demers, whose mother, Suzanne, owns the home, said the family is considering appealing the ZBA's decision. Demers' Fight for Martin Ave. Home Continues

A local family is trying to get on "The Ellen DeGeneres Show" regarding their home, which is unlivable five years after an oil spill.

A Salem family is not giving up their fight five years after an oil spill rendered their home unlivable. Suzanne Demers and her son, Michael, are hoping in the coming months to raze their home at 21 Martin Ave. and either build a new one or replace the foundation and put in vapor barrier to eliminate the odor of fuel. On Feb. 6, 2007, over 200 gallons of home heating oil flooded their basement. The Demerses said it was because an employee of Haffner's Oil in Lawrence, Mass., overfilled their tank. But they lost their court case against Haffner's, Haffner's insurer Acadia, and two companies responsible for the clean-up, Enpro Services and Ambrose Environmental Management, Inc.  Michael said his mother now finds herself $200,000 in debt and …

Bail Argued in McDougall Case

The obstruction of justice charge against the Salem elected official was changed from a Class B to a Class A misdemeanor.

Salem Budget Committee and Zoning Board of Adjustment member Patrick McDougall appeared in the 10th Circuit Court of Salem Tuesday and after a back-and-forth between attorneys, no change was made to McDougall's bail. McDougall, 37, was arraigned Tuesday on the charges stemming from his Aug. 31 arrest, including three felony witness tampering charges and misdemeanors of criminal threatening and disorderly conduct. Following a request by Salem Police prosecutor Jason Grosky, the original obstructing government administration charge against McDougall was changed from a Class B misdemeanor to a Class A misdemeanor. McDougall, Azarian Have Testy ZBA Exchange

Azarian believed McDougall was questioning his integrity on a potential re-hearing.

Salem Zoning Board of Adjustment Chairman Gary Azarian took offense Tuesday night to what he believed was an attempt by fellow board member Patrick McDougall to question his integrity on a petition. During the exchange, Azarian referenced the pending criminal charges against McDougall. It all centered around a request for a third re-hearing from Edward Lynch, an abutter to the property at 9 Atkinson Road. The property, owned by Tommy Porter, has enjoyed a preexisting, non-conforming use. A re-hearing was held in August in which the board's decision was upheld. The trial for a charge of obstructing government administration against Salem Budget Committee and Zoning Board of Adjustment member Patrick McDougall has been pushed back after the trial had been scheduled for Wednesday in the 10th Circuit Court of Salem. McDougall's next court date on that charge is for a motion hearing Oct. 9, according to a clerk at the court. McDougall, 37, was originally charged in July for a late-June incident in which his wife called 911 complaining of a migraine headache and Patrick McDougall allegedly refused to allow her to be transported after paramedics arrived, and he got into an argument with the paramedics and later police on scene. Police affidavits obtained by Patch reveal more details about the two incidents that led to the Friday arrest of Salem Budget Committee and Zoning Board of Adjustment member Patrick McDougall. McDougall, 37, of Tiffany Road, now faces three witness tampering felonies and individual charges of criminal threatening and disorderly conduct.  McDougall, who is also a Republican seeking a seat in the N.H. McDougall Charged With Witness Tampering, Threatening

The Salem elected official faces five new charges stemming from Friday incident at the Fire Station, Sunday incident at his home.

UPDATE, SUNDAY, 11 a.m.: In a brief phone interview with Patch, Patrick McDougall did not comment on the new charges against him, saying he would be speaking with his attorney and working on a defense. McDougall said he has no plans to alter his run for the state House of Representatives, or leave either the Budget Committee or the Zoning Board of Adjustment. McDougall said he does not plan to attend tomorrow's GOP Labor Day Picnic.
